Important: NewLastName.org is not a law firm and does not provide legal advice. We provide self-help tools that auto-fill government forms based on information you provide. By using this service, you agree to these terms in full.

1. Acceptance of Terms

By accessing or using NewLastName.org (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms at any time by posting changes on this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

NewLastName.org provides automated form-filling tools that help users complete government name change forms. The Service:

Pre-fills official government PDF forms (such as SS-5, DS-82, DS-11, Form 8822, and state court petitions) based on information you provide
Generates downloadable, completed forms for you to print, sign, and file with the appropriate government agencies
Provides informational guides about name change processes by state and agency

The Service does not file forms on your behalf, submit anything to government agencies, or guarantee acceptance of any filing.

3. Not Legal Advice

NewLastName.org is not a law firm, does not provide legal advice, and is not a substitute for the advice of an attorney. The information and tools provided are for informational and self-help purposes only. No attorney-client relationship is created by your use of the Service. If you need legal advice regarding your name change, custody dispute, immigration matter, or any other legal issue, consult a licensed attorney in your jurisdiction.

We make reasonable efforts to keep our forms and guides accurate, but government forms, fees, requirements, and procedures change frequently. You are solely responsible for verifying that any form you submit is current, accurate, and appropriate for your situation.

4. No Warranty; Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

The Service will be uninterrupted, error-free, or secure
Forms generated will be accepted by any government agency
Information on the Service is complete, accurate, or current
The Service will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NEWLASTNAME.ORG, ITS OWNERS, OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

5. Assumption of Risk

You acknowledge and agree that:

You are solely responsible for the accuracy of all information you provide
You are solely responsible for reviewing, verifying, signing, and filing any forms generated by the Service
Government agencies may reject, return, or require corrections to forms for any reason
Name change laws, fees, and procedures vary by state and may change without notice
We are not responsible for delays, rejections, or adverse outcomes resulting from your use of the Service

6. Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

You and NewLastName.org agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration rather than in court, except that either party may bring claims in small claims court if eligible.

6.1 Arbitration Rules

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures, or by another mutually agreed-upon arbitration provider. The arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.

6.2 Class Action Waiver

YOU AND NEWLASTNAME.ORG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

6.3 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@newlastname.org within 30 days of first using the Service. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

7. Indemnification

You agree to indemnify, defend, and hold harmless NewLastName.org, its owners, operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you provide through the Service.

8. Acceptable Use

You agree not to:

Provide false, misleading, or fraudulent information
Use the Service for any unlawful purpose, including identity fraud
Attempt to gain unauthorized access to the Service or its systems
Scrape, crawl, or use automated means to access the Service without written permission
Interfere with the operation of the Service
Use the Service on behalf of another person without their explicit consent

9. Intellectual Property

The Service, its design, code, guides, and original content are owned by NewLastName.org. Government forms filled by the Service are public domain documents. You may not copy, reproduce, or redistribute our proprietary tools, guides, or content without written permission.

10. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. Upon termination, your right to use the Service ceases immediately. Sections 3-7 survive termination.

11. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any litigation permitted under these Terms (e.g., small claims) shall be filed exclusively in the state or federal courts located in Multnomah County, Oregon.

12. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. If the class action waiver in Section 6.2 is found unenforceable, then the entirety of Section 6 (Arbitration) shall be void.
